WAIVER

As evidenced by the signature below, Participant (parent / legal guardian) understands and
agrees to comply with the following:

 

  1. Deposits.  Participant understands that the $_________.00 deposit will not be refunded unless Participant elects to enroll in the Refund Program.
  2. Cancellation Policy.
    1. Cancellations must be made in writing to Martin Educational Tours, Inc.  For purposes of this Agreement, “writing” shall be limited to e-mail, facsimile, and letter. The effective date of cancellation will be the date in which Martin Educational Tours, Inc. receives the written correspondence.
    2. Martin Educational Tours, Inc. reserves the right to cancel the trip for conditions out of its control which include, but are not limited to, an act of God, war, terrorism, civil conflict, etc.  In such event, Martin Tours, Inc. will reimburse all fees / expenses that it has received except any fees / payments that it has paid to vendors who will not reimburse Martin Educational Tours, Inc.
    3. Refund Policy.  If Participant submits a written cancellation notice as required under paragraph 3, the refund schedule is as follows:
      1. No refunds once the trip begins.
      2. 1-60 days:    Martin Tours, Inc. will reimburse all fees / expenses that it has received less any fees / payments it has paid to vendors that it cannot be reimbursed, less deposit.
      3. 60+ days:  Full refund less deposit.

 

  1. Refund Program:  Participant understands that he / she can elect to enter the refund program by circling yes or no below and paying a $75.00 fee.  Under the Refund Program, Participant is returned the entire balance he / she has paid.

  1. Illness, Injuries, Death, Lost Property, etc. 
    1. Martin Educational Tours, Inc. cannot be held responsible for any claim of personal injury, loss of earnings, property damage, etc. from any event caused by hotels, buses, vendors, etc. or any sub-contracted service providers except to the extent / percentage attributable to the negligence or wrongful action of Martin Educational Tours, Inc.
    2. Martin Educational Tours, Inc. is not responsible for personal injuries, death, property damage, or any other claim brought by Participant except to the extent / percentage attributable to the negligence or wrongful action of Martin Educational Tours, Inc.
    3. Martin Educational Tours, Inc. cannot be held responsible for any of Participant’s lost or stolen property and Participant agrees that Martin Educational Tours, Inc. is not responsible for looking for Participant’s lost or stolen property.
    4. Participant agrees to indemnify and hold harmless Martin Educational Tours, Inc., its employees, agents, and members from and against all demands, claims, damages to property and / or person, medical expenses, losses and liability (including reasonable attorney fees) except to the extent / percentage attributable to the negligence or wrongful action of Martin Educational Tours, Inc.

 

6.  Damage to Property.  Participant is solely responsible for any damage he / she causes to hotel, coach, sites, etc.  Participant agrees to indemnify and hold harmless Martin Educational Tours, Inc., its employees, agents, and members from and against all demands, claims, damages to property and / or person, losses and liability (including reasonable attorney fees) except to the extent / percentage attributable to the negligence or wrongful action of Martin Educational Tours, Inc.

7.    Behavior:  Participant understands that he /she is required to abide by all applicable laws of the jurisdiction where Participant is located.  Additionally, he / she understands that Martin Educational Tours, Inc. may suspend Participant’s trip without refund and require that the participant be sent home at his / her expense should Martin Tour Inc. believe such action is necessary.
